Heralded by the Communications and Multimedia Act 1998 and driven along by the rapid evolution of technology, the Malaysian telecommunications sector is well on its way to the convergence of telecommunications, broadcasting, multimedia and on-line content industries. Emerging services such as 3G, HSPDA, mobile TV, digital multimedia broadcasting and RFID applications present network operators, content providers and other service providers with huge opportunities and potential upside but require the regulatory, technology and deal risks to be effectively managed and addressed.

We work closely with a multiplicity of our “convergence” clients in addressing the regulatory, contractual and policy issues that may relate to their intended service offerings, collaborative tie ups with business partners and technology acquisitions, as well as in managing the various legal issues arising from the advent of emerging services and new regulatory initiatives.

Our Services Include:

  • Structuring and drafting contractual documentation pertaining to subscription and use of operator’s voice, data and content services, inclusive of addressing related licensing and regulatory issues
  • Advising, drafting and negotiating agreements relating to the procurement of systems, software and services necessary for the provision of operator services, including equipment acquisition, software licences, mobile content development and provisioning agreements, as well as third party collaboration agreements for the provision of content and services
  • Advising on all aspects of telecommunications, network and content regulation, obtaining required regulatory approvals, compliance with industry codes, preparing submissions and advice on proposed legislation, guidelines and public consultation exercises
  • Assisting clients to acquire and maintain compliance with telecommunications licences, as well as to assist clients in the negotiation of access and interconnect agreements
  • Drafting and negotiating of agreements for the purchase of telecommunication capacity with telecommunications service providers for client’s voice and data requirements.
