Electronic Financial Services

The financial services sector has been at the forefront in the adoption and leveraging of information technology solutions in order to establish new electronic transactional channels via which new financial products and services such as internet banking, mobile banking and on-line securities trading, are delivered to their customers.

We assist our financial sector clientele not only in relation to the drafting and negotiation of the contracts relevant to the acquisition of the information technology solutions that make such electronic financial services possible, but also in structuring, drafting and negotiating the entire range of agreements and documentation required between our clients, their partners, merchants and customers in order to operationalise their intended electronic financial service, be it consumer or corporate internet banking, mobile banking and payment services, e-procurement services or connecting corporate treasury systems to the international banking network.

Our Services Include:

  • Drafting all agreements, terms and conditions and policies pertaining to subscription to and use of various electronic financial services including internet banking, mobile banking, on-line securities trading, e-procurement, payment services
  • Advising clients on compliance with existing legislative provisions (e.g. Banking and Financial Institutions Act) as well as the applicable guidelines and regulations issued by the relevant industry regulator (e.g. Bank Negara Malaysia, Securities Commission, Bursa Malaysia)
  • Advice on the Digital Signature Act, E-Commerce Act, Payment Systems Act, Anti-Money Laundering Act and other technology related legislation and regulations
  • Drafting and negotiating all agreements relating to the procurement of systems, software and services necessary for the provision of the electronic financial services, inclusive of portal development, hosting, content provisioning, support, e-fulfilment, encryption and user authentication
